The Retailers Association of India (RAI) has flagged inconsistencies in the implementation of shop operating hours across Maharashtra, after members reported being asked by local administration and police authorities to shut retail establishments at midnight despite provisions allowing 24-hour operations.

Under the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017, establishments are permitted to operate round the clock, provided employees are given a weekly holiday of 24 consecutive hours. However, RAI noted that on-ground enforcement has not always aligned with the Act, leading to operational uncertainty for retailers.

Following representations made by RAI, the Maharashtra state government issued a clarification reiterating that, with the exception of establishments selling or serving liquor, shops and commercial establishments are legally permitted to operate 24 hours a day, subject to compliance with employee welfare provisions. The circular also directs local authorities to ensure uniform implementation of the Act across jurisdictions.

RAI stated that the clarification is expected to bring greater consistency in enforcement, reduce friction at the local level, and provide retailers with clearer operating guidelines in line with existing legislation.
